Arc Creations LLC Terms & Conditions

These Terms & Conditions ("Terms") constitute a legally binding agreement between you ("User") and Arc Creations LLC ("Arc Creations," "we," "us," or "our") regarding your access to and use of our website www.arccreations1209.com, mobile application, and any related services offered by Arc Creations (collectively, the "Platform"). 

 

1. Acceptance of Terms

By accessing or using the Platform in any way, you agree to be bound by these Terms. If you do not agree to all of the Terms, you are not authorized to access or use the Platform. 

 

2. Modifications to the Terms

We reserve the right to modify these Terms at any time. We will notify you of any changes by posting the revised Terms on the Platform. Your continued use of the Platform after the revised Terms are posted constitutes your agreement to the changes. 

 

3. User Accounts

You may be required to create an account to access certain features of the Platform. You are responsible for maintaining the confidentiality of your account information, including your password, and for all activities that occur under your account. You agree to:

  • Provide accurate and complete information when creating your account. 

  • Keep your account information updated. 

  • Not share your account information with any third party. 

  • Notify us immediately of any unauthorized use of your account or any other security breach.

  • Infringe on the intellectual property rights of Arc Creations or any third party. 

  • Transmit any content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, hateful, or racially or ethnically offensive. 

  • Interfere with or disrupt the Platform or servers or networks connected to the Platform. 

  • Use the Platform to impersonate any person or entity. 

  • Attempt to gain unauthorized access to the Platform or any portion thereof. 

  • Use any automated system, such as a robot or data scraping tool, to access the Platform. 

 

5. Intellectual Property

The Platform and all content and materials included on the Platform, including but not limited to text, graphics, logos, icons, images, videos, and software, are the intellectual property of Arc Creations or its licensors. You are granted a limited, non-exclusive, non-transferable license to access and use the Platform in accordance with these Terms. 

 

6. User Content

 

You may submit content (such as reviews, comments, or photos) to the Platform ("User Content"). You retain all ownership rights to your User Content. By submitting User Content, you grant Arc Creations a non-exclusive, royalty-free, worldwide license to use, reproduce, modify, publish, and translate your User Content in connection with the Platform. 

You are solely responsible for your User Content and represent and warrant that you have all rights necessary to grant the foregoing license.

 

7. Disclaimer 

 

The Platform is provided "as is" and without warranties of any kind, express or implied. Arc Creations disclaims all warranties, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. 

Arc Creations does not warrant that the Platform will be uninterrupted or error-free, that defects will be corrected, or that the Platform or the server that makes it available are free of viruses or other harmful components.

 

8. Limitation of Liability

 

Arc Creations shall not be liable for any damages arising out of or related to your use of the Platform, including but not limited to direct, indirect, incidental, consequential, punitive, or special damages. 

 

9. Termination 

 

We may terminate your access to the Platform at any time, for any reason, with or without notice. You may also terminate your account at any time. 

 

10. Governing Law 

 

These Terms shall be governed by and construed in accordance with the laws of the State of Michigan, without regard to its conflict of law principles. 

 

11. Dispute Resolution 

 

Any dispute arising out of or relating to these Terms shall be resolved by Binding Arbitration as set by American Arbitration Association rules. 

 

12. Entire Agreement 

 

These Terms constitute the entire agreement between you and Arc Creations with respect to your use of the Platform. 

 

13. Severability 

 

If any provision of these Terms is considered to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall remain in full force and effect. 

 

14. Waiver

No waiver of any breach of any provision of these Terms shall be deemed a waiver of any subsequent breach.
